Land for mom

My mother married. Her husband owns the land and property they currently reside. They have been married for 11 years. He is currently in the hospital and his chances of survival does not look good. What rights do my mom have to have the land & property turned over to her? What are the legal implications, if any? What should she do to protect herself of any tax consequences?

If her husband has a will, your mother will get whatever her husband has given her in the will. If there is no will, and there are other surviving relatives such as children from her deceased husband's prior marriage(s), she is likely to receive no more than one third of the value of the assets as her share of her deceased husband's estate.
