Legal Question in Real Estate Law in Virginia

If I have land, and there is an old piece if machinery that's been on there for 25 years and someone says it's theirs and just takes it , is that legal, or is it technically mine if it's been on my property for 25 years?

No, merely because this mechanical relic has been resting on your land

for the last 25 years would not in and of itself necessarily

confer title to it to you (in my opinion).

If the one who is offering a competing claim to its ownership were able

to offer credible documentation as to why he should be considered the

true owner, that might well trump your claim, legally speaking, as to the

true ownership of this equipment. (It should be noted, however, it would not

be appropriate for this individual to simply go onto your property and remove

this machinery without a further resolution as to who is actually entitled to claim ownership of it. He might well find himself the subject of theft charges as well as other civil claims by so doing.)
