What is the legal and financial recourse for a developer controled HOA to collect delinquent HOA fees in state of VA?

The HOA (whether "developer controlled" or not) should have the statutory

authority outlined in Title 55 of the Code of Virginia that any other HOA would have to collect such fees/assessments deemed delinquent under the existing bylaws of the association.
