Legal Question in Real Estate Law in Virginia
Do I have any legal recourse for a deck on my home that fell and injured me? I have owned the home for almost three years. The deck was not built to code and it was attached to the house by simply nailing it to obvious insect damaged wood.

There is a statute of limitation on personal injury claims in the
Commonwealth normally limited to two years, but if the deck were constructed pursuant to an oral or written agreement, the statute of limitations for a breach of contract action should be three or five years, respectively.
