Liability of builder

I own a home in Virginia constructed with xxxx. I've owned it for 13 years. I bought it from the builder. I have just discovered extensive damage behind the walls (rotted and termite damaged wood) as a result of improper installation of this material.

There are several class action suits related to this (North Carolina is one state).

My home is unsafe as a result of the rotted wood. I was unable to see the damage behind the walls.

VA's Limitations on builder liability

Unfortunately, Section 8.01-250 of the Virginia Code provides a 5 year "Statute of Repose" barring actions against builders after5 years after the work was done.
