Legal Question in Real Estate Law in Virginia

live in boyfriend's possesions

My ex boyfriend who left his wife for me and moved all his personal possesions into my home has returned to his wife after three months. I don't want to give any of his things back, i want to donate some of them and keep others. Will I be forced legally to return them?

Re: live in boyfriend's possesions

I think that deep down you already know the answer!! You have to give everything back... his possessions are his not yours.

Of course there are some limits. The law does not require you to look after his things forever, and if he clearly gives you an indication that he is abandoning his things then you can dispose of what he left with you. Normally speaking in these situations a court will look at a variety of factors: is he paying part of your rent? is his name on the lease, has he asked you for permission to keep his things at your place, did he tell you he would be back in a reasonable amount of time to retrieve his belongings, have you ousted him from your apartment, have you attempted to make arrangements for him to come back and retrieve his belongings, have you told him it would be OK for him to leave things with you for a while? and the list can go on and on. Assuming that he just abandoned his things then you should give him notice that if he does not come back and pick everything up in a reasonable amount of time (a month or so), then you will dispose of everything. Make sure that he truly receives this notice. If you instead just get rid of everything, without following these reasonable steps then he can sue you for the value of the things he lost.

Yes, if he asks for their return.
