Legal Question in Real Estate Law in Virginia

I live in VA and took out a judgment in VA against my nephew in NC. I went to NC and filed a foreign judgment. I just noticed he sold his house. I thought the settlement attorney should have searched the courthouse for judgments or is that only for a lien on the house. If it is for ANY judgment do I sue the Attorney for not doing their job. Unless there had been a lien recorded against the property in the N. Carolina jurisdiction where it was located, the matter would likely not have come to the attention of the settlement attorney.
