Legal Question in Real Estate Law in Virginia

Living with ex boyfriend

Eight months ago my boyfriend and I found a home to buy. My credit is not as good as his so the house was put in only his name. My children, boyfriend and I all moved in the house the same day of closing. I gave him 1,000.00 toward the closing cost. I have put a lot of money into making repairs to the home and property. All of this with intentions of getting married and living in the home forever. But now we have decided not to get married and part ways. He said my kids and I need to move out in 30 days. Can he kick my children and I out? If so, legally what can I do? How much time does he have to give us to move out?

In order to have you legally evicted from this house, your (ex?) boyfriend will

most likely have to follow the standard procedures for eviction that any

other landlord would have to follow in that locality in the local general district court by filing the standard Warrant for Unlawful Detainer.

But if he should follow through with this legal action, you might want to visit

the clerk's office to see about filing a counterclaim against him for the

value of your monetary and labor investments which you've already

expended on this property thus far.
