Can my mom's brother legally auction off his half of the property when she is living on the property? Her brother is in jail currently awaiting trial because he is a felon and had pulled a gun on my sister and her kids. Today someone showed up to appraise the property saying he was auctioning off his half of the property.

Yes, it could be possible if this brother is the legal owner of at least a half interest in

this particular property (and a buyer for such an interest can be found).
