mortgage adj rate claim loan modifiation but didn't

Do we have a case against our lender for claiming a loan modification and than did a forbearance with no intentions of ever modifying our terms. We can't even get lenders that are helping 1000's of people like us due to our lender wont accept pay off due to they would have to pay closing cost they would rather foreclose on a house than help. they lai to help but we have been with them for close to 5 years force to file bankruptcy to have it dismissed after 2 years of a 5 year plan due to unable to keep up with the additional $1100 dollar payment plus $1400 for our house attorneys we hired have not been any help since we hired them we were treated with great disrespect we feel we have no where to turn to and are desperate to keep our home for our children's sake.

Well I don't know what is going on with the attorneys you already have, and if you have money tied up there you definitely need to unravel that.

The first thing I would do is find out if your mortgage is INVALID because of technicalities in the mortgage paperwork. It may be that they made mistakes in the legal paperwork, and cannot collect on the mortgage.

Can I guarantee it? No of course not, but I am saying that the first thing you would want to check is whether the mortgage is legally defective, before trying anything else, especially if the lender is being uncooperative.
