Legal Question in Real Estate Law in Virginia

We moved into a townhouse in the Green Run area of Virginia Beach, VA 3.5 years ago. The Green Run Home Association recently informed us that the fence (that has been in place years before we moved in) is 5 feet outside of our property onto the common property. We've been given an ultimatum with penalty of a $900.00, if we don't move the fence. Is this legal?

Hard to say on these few facts. Better first ask to see what evidence the HOA is relying on for their claim such as the results of a recent survey or whatever. Then you might wish to arrange for a consultation with a local attorney who handles real property law matters for his or her
