Legal Question in Real Estate Law in Virginia

Neighbor is blocking easement

My neighbor put up a fence blocking an emergency easement. In otherwords we have to cross a concrete bridge daily to leave our property but everytime it rains the bridge floods. The property she is blocking is not hers and she as we did signed a deed saying she would not block any right of ways. My court date and has been postponed for another two months. Meanwhile even though i have plats to indicate clear propery lines my lawyer says there is nothing we can do! When it rains we are trapped. I have children and get get them out if they need medical help and my husband is losing time and wages at work. What can we do?

Re: Neighbor is blocking easement

If you or family members are faced with an actual emergency situation and are unable to obtain egress from your property by any other reasonable means, then you would likely have the right to have the blocking fence removed.
