Legal Question in Real Estate Law in Virginia

Non-Disclosure of Faucet Location in New Home

We are in the process of purchasing a new townhouse. We opted to go with the basic sink option that came with the upgraded of granite countertops ($8k). The build failed to disclose that the faucet would be located to the right side (as opposed to the typical center). The faucet swivels over the countertop, which means it's possible to pour water all over your counter. They are refusing to change the sink (because they would have to rip up the granite countertop) saying it is the standard design. Do I have any options to get them to change it prior to settlement since they failed to disclose the location? We would have upgraded the sink too if they had informed us of this. Thank you in advance.

Re: Non-Disclosure of Faucet Location in New Home

Chances are that under the purchase agreement which you were operating under, the builder had no obligation to disclose those particular details unless you had made specific inquiry (which, apparently, you did not do).
