Legal Question in Real Estate Law in Virginia
I am getting with an outrageous waterbill by my apartment. This is a large apartment chain in the VA and NC area. My apartment use's the RUBS system for the waterbill (Ratio Utility Billing Service). They take the number of occupants and sq. footage of apartment and divide the waterbill. According to the apartment comples only 6 people live in my building. 3 in my apartment (one is a 6 mo old) and 1 in the other each of the other 3 apartments as listed on the Lease for my building. I know for a fact that up 3-4 unauthroized occupants are living in my building for several months and I'm paying for thier waterbill. Each apartment for 1 person while up to 3 are living in the apartment, leaving my husband and I to soak up any extra water usage. My waterbillis 75 dollars a month for 2 people while the other authroized and unauthroized people are being billed for half that. The apartment complex is not being responisble for the number of tentants living in thier apartments and I beleive it is ILLEGAL to have unauthroized people living in your apartment without written consent. Please help me

It would appear that you would first need to establish credible proof that these unauthorized occupancies are a regular and ongoing occurence in the units which you believe are involved and bring it to the attention of the apartment management. And, if they refuse to do anything about it, you could then report any suspected violations to the approrpriate county agencies which are responsble for monitoring compliance with local ordinances having to do with housing occupancy requirements.
