Legal Question in Real Estate Law in Virginia

former owner of our house put a fence with a gate that goes into the neighbors property this is a large double gate there is a road that runs through this. Our neighbor has now decided to plant bushes in front of that fence on his side. Gate has been there for at least 20 plus years. can he do this?
