Legal Question in Real Estate Law in Virginia

Do I have to pay?

My boyfriend and I purchased a mobile home in Wmsbg Va. 9 years ago--The title of the mobile home was placed in my name first and his name as co-owner due to his bad credit score-4 years later we broke up and I purchased a home in Hampton,Va for myself and our daughter-He had nowhere to go and wanted to retain the mobile home-My verbal agreement with him was he could if he would keep all payments up to date-the city of Wmsbg has been trying everything to get me to pay the personal property taxes on this mobile home which I did for 2 years but now I just can't afford it--they tried to garnish my wages(it didn't work) they placed a bad mark on my credit-and they contacted the DMV to keep me from renewing my vehicle plates--recently laid off-no means of paying-What can I do? Can I legally evict him and rent the property? Do I have a civil case?

Re: Do I have to pay?

Your remedy is to file suit to have the property

sold with the proceeds of the sale first going to pay off all liens and other assessments against the property (including City of Williamsburg)with the remaining amounts divided between the owners according to their respective contributions.

If your boyfriend is in fact a co-owner of the moblie home, he is entitled to be in possession(as you in fact also are)and evicting him from the premises would not be an option.
