Legal Question in Real Estate Law in Virginia

Probate Will

Is it necessary to probate a will when my wife is the sole heir? There is a house paid for involved and we intend to keep it in the family and several cars all of which will remain in the family? We have the death certificate

Re: Probate Will

Assets which are held jointly between you and your

wife such as property held jointly with right of survivorship or by the entireties, or jointly held bank or brokerage accounts, life insurance proceeds with your wife as intended beneficiary, even a motor vehicle are examples of assets all of which can pass outside of a will to the intended survivor of the joint relationship without the benefit of a will and the attendant probate process. However, the assets must be titled in the correct manner in order for this

process to work smoothly.
