Legal Question in Real Estate Law in Virginia

Problem with buyers

We sold a home. 8 months later we get a call saying the basement is leaking all the time. We only had 1 problem during the time we lived there. 6 years. The home has sump pump which stopped working due to a power outage so we had some leaking during the power outage (there were heavy storms that day). We were not asked anything about the basement and didn't think to mention it since it was a 1 time occurence and had not happened since. Now they are threating to sue. There was an inspection done and we fixed all the requested items not knowing that this was an issue at all. We all signed an ''as is'' disclaimer. There was no disclosure requested of us if. I don't feel like this should be our responsibilty. The basement didn't leake like they describe when we lived there. Only that 1 time occurence.

Re: Problem with buyers

As long as you disclaimed on the standard form and made no representations about condition of the basement, you should have no liability. If you made any false or misleading statements, that would be a different story.
