Legal Question in Real Estate Law in Virginia
I am currently having a problem with my leasing office. My husband and I moved into our apartment that the leasing office didn't let us see before we moved in. I noticed the balcony has orange foam coming from the cracks plus it looks like it's going to fall down. We don't even sit on the balcony for this matter. I've been complaining to the leasing office and they are still not acting on this concern. What should I do?

Whether the condition of the balcony as described would constitute a material breach of your lease would appear problematical at best, but further relvant facts related thereto would likely have to developed and evaluated before a more definitve answer might be offered.
Your mistake, obviously, was agreeing to move into this apartment apparently without first subjecting it to a thorough inspection.
