Legal Question in Real Estate Law in Virginia
My property manager has paid my mortgage late (once) and my association fee late (three times). I want to terminate him immediately. The contract says I have to give 60 day notice. But I don't want to pay him anything more. The renter is going to pay me directly. Can I just stop paying him because of the late payment and send a cancellation letter.

Would seem to depend upon whether these lapses as described constitute
a material breach of the contract---or not, and, therefore warrant the remedy of
immediate recission.
Without further relevant and clarifying facts on the matter (including tme periods involved), and not having had the opportunity to review the contract itself, I would be inclined to play it safe and give this property manager the 60 day notice.
