Legal Question in Real Estate Law in Virginia

I purchased a used car from a dealer 12/23/10 and I have had to take it back twice because it keeps cutting off and the check engine light came on. They couldn't figure out why it keeps cutting off. All I want to know is am I entitled to get my down payment back?

Not too likely with a used car and presumably limited or no warranties at all.
