I put $4,000 down on a house, and I was rejected by same lender twice. Can I get the downpayment back, it is in escrow?

No, these funds would not be in escrow, but the terms of your contract

with the lender should provide for the return of this "earnest"

money (or whatever it was called) under he circumstances described.
