Legal Question in Real Estate Law in Virginia

Quick Claiming a house after a divorce

I have a question, in my divorce decree it was stated that my ex-husband has to quick claim our house to me. He has not done this yet and it has been over two years. Do I need him to get this done or can I do this without his consent since it is our court documents.

Re: Quick Claiming a house after a divorce

No, only the legal owner of the interest in the property being quitclaimed may execute the quitclaim. (You may need to have your former husband brought back to court to answer for his failure to carry this through. It's referred to in the law as having him SHOW CAUSED)
