Legal Question in Real Estate Law in Virginia

Raising rent without a lease.

My landlady called to say she is raising the rent. She said she sent me a letter, which I have not received. Even though I asked for a lease, and she did not give it to me 2 1/2 years ago, Does she have to notify me in writing and should she have to give me 30 days? She called me on Oct 3rd

and is requesting the raise for Nov 1st., which is not 30 days. Can I delay the raise of the price until December because of the time frame? Can I delay the raise because the letter has not reached me?

Thank you

Nina

Re: Raising rent without a lease.

If your lease is under the VRLTA (Virginia Residential Landlord Tenant Act), the terms of the Act would govern your particular situation.

(You can find the terms spelled out in the Virginia Code under Title 55 available on the Internet.)

If your lease is not governed by this act, then more information would be needed to answer your questions.
