Legal Question in Real Estate Law in Virginia

My father passed away and we are getting ready to sell his property. the neighbors are claiming that the road that has been used to divide the property for 53 years is now on their property and they are claiming that the new buyers of my father's property are not going to be allowed to use the road. the original land plat shows the division line in or approximately in the midde of the road. Since my Dad was the original owner of the entire land, do we as descendents have ''Senior Rights'' for this problem. We just want the buyer's of our father's property to have access to the road to get to the house and property.

Better have a new survey done to determine where in fact the boundary lines fall with respect to these adjoining properties, and then arrange to consult with an attorney who deals with real property and land use issues in the area, and who should be able to further advise you.
