Legal Question in Real Estate Law in Virginia

Real Estate Tax

There are two pieces of property covered by the deed to my home. When I re-financed my home 10 years ago, the attorney who handled the closing omitted the small lot listed in my deed. The property tax rolls in the county where I live show two separate pieces of property and they code for the mortgage company paying the tax. The smaller piece of property was not coded by the attorney. When the smaller bill began to come to my office, I began forwarding them to the mortgage company and eventually, I did not receive the bill and thought the matter resolved. In 2001, I received a notice that my property would be sold at auction for failure to pay $56.00 in taxes on this piece of property. I have written to both the lawyer and treasurer of the county. The treasurer never replied and the lawyer cannot comprehend that there are two pieces of property included in my deed. It cost me $486.00 to resolve this problem. Willl my title insurance cover this?

Re: Real Estate Tax

No. Title insurance will not cover it. You should have just paid the $56.00, since it should have been clear that the bank did not pay it, and that you were not paying the bank for it.
