Legal Question in Real Estate Law in Virginia

real estate/divorce

My husband's mother bought us a house before we got married. Both of our names are on the deed. If we divorce, how will the house be divided since she paid for it??

Re: real estate/divorce

Assuming that the Deed does not assign you an ownership percentage of the home (as it might if you owned the home as "tenants in common"), under these facts you likely own the home as "tenants by the entireties" (the type of ownership reserved for married couples) and would be entitled to 1/2 of the proceeds of the sale.
