Legal Question in Real Estate Law in Virginia

Registering as a Landlord in Falls Church, Virginia

Does one have to register as a landlord in Falls Church, VA? My roommate recently purchased the home that both him and I are currently residing in and I am currently paying rent to him. However, I have noticed on the checks that I have provided him, he writes ''Deposit Only''. I'm not sure if he has a legal obligation to state that he is a landlord since I am paying rent to him and he is receiving this money to pay for the house he has just purchased. I do not believe he has registered in any way. Does he need to do this?

Re: Registering as a Landlord in Falls Church, Virginia

There can be many different kinds of landlords

in any given jurisdiction and I doubt that any of them are required to "register" as such, either in Falls Church or anywhere else.

If you are paying your roommate rent who also happens to be the owner of the house in which you reside, this person is receiving rental income which is reportable to the IRS as well as the Commonwealth of Virginia.

The term "For Deposit Only" is a banking term and of little significance in and of itself as it simply means that the check is to be deposited and not subject to any further endorsements other than that of the payee whom the check is made out to.
