Legal Question in Real Estate Law in Virginia

Getting name removed from mortgage

I am seperated from husband and no longer living in same residence. I have since lost my job amd apartment, and cannot get housing assistance because my name is still on the mortgage. I have been told that I cannot have my name removed unless my soon to be ex, refinances. He cannot refinance due to a bankruptcy. Is there anything I can do about it? I have young children and need housing.

Re: Getting name removed from mortgage

Even if your name is still on the mortgage, this should not be a bar to your receiving housing assistance for yourself and your children as long as it's clear that you and your children are not able to live in or occupy the house nor are you able to access any of the equity which may have accumulated.
