Legal Question in Real Estate Law in Virginia
Removing a lien on a property
My partner and myself obtained a deed on a property with full knowledge that there was a lien against it for $9800. The money has been paid to the person holding the lien and he is cooperative in removing such lien.
Neither the lien holder nor ourselves know the process to remove the lien, what should we do?

See a local real estate attorney and he/she can handle it correctly for you. You must follow the statutory procedure.
Re: Removing a lien on a property
Talk with a clerk of the civil division of the
circuit court in the jurisdiction where the property is located. S/he may have helpful
information as to how to get the lien released and
may even have preprinted form(s which the seller
could use to execute the release of the lien.
Whatever form is used, remember that, among other things, the release of the lien must be properly recorded in order to be effective.
