Legal Question in Real Estate Law in Virginia

Renter in Foreclosure

I'm renting my townhome from my brother who has filed chapter 7 and have not paid the rent. He will soon be in foreclosure. What are my options, if I have been paying him can they put me out on the street. Can I have an option to take over the mortgage with non perfect credit?

Yes, they(the new owner(s)) can put you out on the street, i.e., evict you once the foreclosure is complete. And, no, "with non perfect credit", it's exremely unlikely that you would be permitted "to take over the mortgage" under these circumstances.
