Legal Question in Real Estate Law in Virginia

Re-"Right of first refusal" Contracts

My great grandmother has signed a right of first refusal contract on the home that I am renting from her. She wants to GIVE me the home, but can't get a clear cut answer from her lawyer as to whether that is legal. Is it legal for her to give the home away? If that is not possible can we sign a "rent to own" agreement stating that the money that we pay in rent for the duration of the 9 year contract will be applied to the payment of the home at the end of the term-is this solution legal? Do you have any suggestions on how to get around this contract that my 90 year old grandmother was tricked into signing - legally? Thank you so much for your advise and/or suggestions.

Re: Right of First Refusal

The answer depends on the terms of the contract and the circumstances of its execution. Her lawyer may not have a clear answer because the answer may not be clear, but if you want another Va. real estate lawyer to look at it, feel free to contact me.
