Legal Question in Real Estate Law in Virginia

Who is responsible for the mortgage and bills

My uncle and his family was in a car accident a month ago. Three of the family members died in that accident. The Aunt and two of their children survived the crash. Uncle and Aunt both has their name on the loan for the house. What happens to the mortgage bills ? Also what happens to all the other credit card bills which were solely on the Uncle's name ? Is the wife responsible for all the bills including the medical bills for the Uncle?

Re: Who is responsible for the mortgage and bills

The surviving spouse will continue to be responsible for paying the mortgage. As to the other outstanding bills, the husband's estate will likely have primary responsibility for the outstanding credit card bills and the medical expenses, but if there are not enough assets in the estate to take care of these, then the creditors will likely expect the surviving spouse to pay(particularly the medical expenses).

All of the above are more than ample reason for the surviving spouse to retain the services of an attorney as soon as possible in order to pursue the appropriate damages from those who are responsible for this tragedy.
