What rights do I have?

My girlfriend of 24 years and I purchased a house in Nov.07. We were married September 08 and I discovered her affair in Oct 08. I found out soon enough that we stopped the marriage license from being sent to the county recorder. I moved out immediately. Now, nearly 7 months later I am still out of the house but I suspect that her boyfriend has moved in and she changed the locks without my knowledge. Both of our names are on the title and the mortgage. I have stopped paying my share of the mortgage and she is dragging her feet with a refi. What are my rights in this situation? I just want out but I want to move back in if she is going to screw around. I at least should have a key to my house, right?

Yes, since as a co-owner you have as much right to occupy the property as she. (I regret to report, however, that she's unlikely to refinance this house anytime soon.)
