Legal Question in Real Estate Law in Virginia

Selling a home with a judgement lien

I have recently discovered that I have a lien on my property in response to a judgement. I would like to sell my home, but would not make enough to satisfy the judgement. Can I sell anyway?

Re: Selling a home with a judgement lien

I am afraid you have not provided enough information. When was the judgment rendered and where? Who is on title now and who was on title at the time of the judgment? Was is the Plaintiff, an individual or the IRS? Property Owners Association? Real Estate Tax accounts?

Please provide additional information and I will be able to express an opinion.

Re: Selling a home with a judgement lien

If the judgement is owed by you, you might consider negotiating the amout required to release the lien. If the lien is properly filed & still valid, it will need to be satisfied before you can convey title to the property.
