Legal Question in Real Estate Law in Virginia

Is there a statute of limitations to suing for equitable equity. I want to sue a family member who owns title to real estate with me. Their name was added only as a will precaution if I were to die. I told them I will sue them if they won't sign the deed to me but they said they consulted an attorney & there is a statute of limitations to sue. The other party has been on the deed for 28 years. Please advise.
