Legal Question in Real Estate Law in Virginia

Stolen Rent

After paying my rent via money order I received a notice that I had not paid. Shortly afterward I received a letter from my complex claiming that their drop box had been robbed and many people's rent had been stolen. Who is responsible for the stolen rent? The complex says the burden of proof is on me to prove that I paid.

Re: Stolen Rent

Your best approach is likely to pay the rent again and then send a formal written notice to the complex for reimbursement detailing the facts of your payment to the drop box. (You may also wish to take your money order recipt to where it was purchased and see whether they can determine whether your money order has been cashed or not and perhaps, issue you a replacement.)

If the apartment complex then rejects or refuses your request and you are unable to obtain a relpacement money order, file your case in small claims court in order to get your reimbursement.
