Street Closure

I recently purchased a property off of a paper street. The street is still legally open. In order to get access to the property the city has informed me I would have to put in a ''cul-de-sac'' and install any items required bu current fire marshall codes. All departments ofthe city have reviewed my current prelim-site plan. The next step is to have a public hearing to approve the street closure. The application to submit to request the hearing requires any adjacent land owners signatures. The neighbor won't sign it. He is basically impeding my ability to use and enjoy my property. As I said the street has always been ''open'' to be completed since it's creation in 1915. The neigbor has lived there 5 years and has never petitioned to have it closed. Now I buy the land and he is keeping me from being able to get to it...or to even be heard at a public hearing for the request to finish the street. Do I have any options? Civil litigation? P.S. I am a builder and would be putting up four houses on the land (it is a large parcel). Neighbors property would quadruple in value since he would have a large amount of road frontage allowing him to subdivide as well. Still, he refuses! What to do?

I would suggest that you retain the services of a local zoning and land use attorney who may be able to find a way around the impediment posed by your neighbor's refusal to sign the application for the hearing.
