Legal Question in Real Estate Law in Virginia

sunken propane tank removed after property was sold.

We brought a house with a sunken propane tank. Seller did not disclose that he leased the in ground tank. The Propane company stated that it was leased only after we stated that we did not want to do business with them. They came and removed the tank without providing proof that it was leased. It seems that they should have went after the sellers not us since that is who they supposely had a contract with.

Re: sunken propane tank removed after property was sold.

So, who in fact actually owned this propane tank?

And, if the property was sold to you with the understanding that the tank came with the property, but in fact was owned by the Propane outfit, then you may have recourse against the seller.
