Legal Question in Real Estate Law in Virginia

I sustained water damage to my condo due to an earthquake. My upstairs neighbors water heater pipes broke and flooded my place. The condo association stepped in and sent a company to mitigate the damage/mold that was growing. The condo association also sent a renovation company to assess extent of work needed to repair my place. (water/mold mitigation company tore out lots of drywall, flooring including baseboards, doors/ door frames etc) as of 9/22 the status was they were waiting for the renovation bid to be approved. Subsequent requests (calls/emails) for updates have gone unanswered. Even from my neighbor's insurance co who was calling to pay the master policy deductible as well as reimburse my ins company- who paid for my personal property loss with no problems. My upstairs neighbor- who has the same or more damage than i do, went to an association meeting Tuesday 10/11 and was told that the condo association wasn't covering any of the

repairs. This was confirmed by the estimator whom i contacted when i wasn't getting a response from the property manager. Estimated repair cost is 20 grand. I sent email communication to the property manager stating I expected a response w/in 24 hrs or I was filing a complaint with the VA board. I received an out of office reply- he's went on vacation!!! So I fwd the message to the president who said he knew nothing about anything etc etc and to wait until the property manager returned. I am BEYOND frustrated. What are my options? I have been living in this mess since 8/25.

So, is the association responsible for these repairs or not? But whether you

even know or not, if the association appears now to be backing away from its initial position on the matter, it's probably time for you to be scheduling an appointment for a consultation with a local attorney who handles these kinds of condo property loss matters and who can advise you, accordingly.

The local bar association can probably provide you with a few names and

the contact information for some of these attorneys in your area if you give

them a call.
