Legal Question in Real Estate Law in Virginia

Have a time share for an RV lot. Agreed to pay for the lot and maintaince fees at time of signing.Rented a cabin upgrade for the family and found that nothing was being maintained. Things that were supposed to be available to use were not and numerious things that were in the cabin were broken. We did pay the maintance fee for awhile and paid off the deed. Ran into financial problems and could not afford to keep up with the payments. told the resort that we did not want the deed anymore how could we settle this or sell it. They just thru it into collections. It has been at least nine years and now we owe more than it is worth. Have been band from the resort. Now in the courts hands. I need to know how to write order of defense or particulars to submit to the court and the resort lawyer by Jan. 7, 2010. How do I put this document together. The court date is in Feb. Thank you. Writing such a Grounds of Defense or Bill of Particulars is a job for an

attorney rather than a layperson such as yourself after the attorney has had an

opportunity to become fully conversant with the relevant facts and pertinent

documents in the case.
