tree fell

During the hurricane in sept 2003 a tree on our property fell and is just laying on top of neighbors shed. who is responsible for removing the part of the tree on his shed? we say he is for the part that is on his property and he should have called his insurance company.

Since hurricanes are, normally, considered "acts of God" for these kinds of determinations, I believe that your position is correct and that the responsibility lies with your neighbor.
