Legal Question in Real Estate Law in Virginia
Tree trimming
We recently received a letter from our neighbor detailing how she intended to hire a tree company to ''thin'' trees on our property whose limbs extended over her property. She added that she could do so at our expense. I understand she has the right to cut back the parts of the tree that extend over onto her property, but how much trimming is appropriate? And are we responsible for the costs of the trimming she is hiring this company to do on her side of the fence? Finally, what happens if the trimming damages the tree and/or makes it unbalanced and possibly prone to fall with high winds?

Re: Tree trimming
Regarding your question as to "how much trimming is appropriate?", that's up to the experts(and one of several good reasons not to try and do it yourself). And, no, you are not responsible for the costs of trimming the trees(your neighbor is). And, if the trimming damages the trees which causes them to fall and cause other damage, you neighbor would be responsible to you for these damages,(and she in turn might have a cause of action against the tree trimming company).
