Legal Question in Real Estate Law in Virginia
What type of lawyer would this require, real estate?
My husband moved out of an apartment over a year ago at the end of the original six month lease and never renewed, at the time all rent was up to date, other roomates remained. Other roomates later fell behind on rent and were evicted, landlord has now contacted my husband and says he owes the overdue rent claiming he was still on the lease. The last tenant on the lease who was evicted is now deceased, we believe he is the one at fault and don't want to pay the price for his irresponsibility. My question is would this be considered a matter for a real estate attorney?

The answer to the last question is yes. The lease document is going to control as to whether you husband remained a tenant on the lease, and therefore liable for rent. (Look for automatic renewal provisions.) If your husband is forced to pay rent, he has a right to seek contributions from all other tenants, or their estates as the case may be.
