Legal Question in Real Estate Law in Virginia

In Virginia, a Condominium can be incorporated. (See Va Code � 55-79.73 ) In Va Code � 55-79.77, ...Any proxy shall terminate after the first meeting held on or after the date of that proxy or any recess or adjournment of that meeting, however, in Va Code � 13.1-847, C. An appointment of a proxy is effective when a signed appointment form or an electronic transmission of the appointment is received by the inspectors of election or the officer or agent of the corporation authorized to tabulate votes. An appointment is valid for 11 months unless a longer period is expressly provided in the appointment form.

I am unfamiliar with the Common Law Doctrine in the which Va Code is superior. Whether � 55-79.77 terminates the proxy after the meeting or � 13.1-847 , proxy is effective for 11 months.

Va. Code Section 55 -79.77 should control on this issue (in my opinion)

since this particular statute relates specifically and only to condominiums

unlike Va. Code Sec. 13.1-847 C.
