Widower looking to Sell My Home

My husband died in 2000 and did not leave a will. Both of our names are still on the deed and the home is paid to $0. Does the property automatically go to the widower(me) or do I have to consult with the children before selling the property.

If it was held as tenants by the entireties (as would be normal), his interest passed to you and you own the whole thing and are free to sell it.

You, as the surviving spouse (and widow) would most

likely now be the sole owner of this property(assuming the children to which you refer were born of your marriage to your deceased husband and that he had no others).

However, to make certain that the above is correct, you may wish to have an attorney who handles real estate matters to examine the title to this property and give his or her opinion, accordingly.
