Legal Question in Real Estate Law in Virginia
During a windstorm a neighbors tree fell on my work truck and totaled it. The neighbors hownowners insurance carrier won't pay stating "acts of god" are not covered however just because their insurance doesn't cover it doesn't mean they shouldn't have some legal liability does it? My homeowners won't cover a vehicle but my vehicle insurance will. However the deductible and other costs are $850.00. Can i sue the neighbor for the deductible? If so under what statute?

You could only sue this neighbor with a reasonable chance of winning if in
fact the fall of this tree was foreseeable, meaning the tree was in pretty decrepit
shape to begin with prior to the fall (in my opinion).
