Legal Question in Sexual Harassment in Virginia

I work in a pretty big place-I am a white female and a black supervisor keeps making derogatory remarks to me-I have made 2 reports and the 2nd finally went to h.r.-manager informed nothing can be done because of no witnesses but to let them know if it happens again-this is crazy-why other if they won't do anything-they gave me 1 day off with pay so we wouldn't be working together while it was investigated-we all know if it happens-when is there an actual witness???

There does not need to be a witness, but whether the company is breaking the law depends on what you mean by "derogatory."
