Legal Question in Sexual Harassment in Virginia

Denial of harassment

My wife was touched in a inappropriate place and the past five days have been hell for her. She is scared at home and often breaks down. The person who did this denied doing anything wrong. The employer is conducting an outside investigation, but she is worried that since he denied doing anything he will not be punished. They still work for the same company but in different buildings. What can she do, because her life has been turned upside down.

Your wife should await the findings of the employer's outside investigation. If the results appear unsatisfactory she may then wish to arrange for a consultation with an attorney knowledgeable regarding sexual harasssment law.

Your wife should also be aware than in sexual harassment cases in the Fourth Federal Circuit, generally where there is only one identifiable incident of what might be characterized as sexual harassment and not an identifiable pattern of ongoing and pervasive illegal conduct, the Court appears to have generally ruled for the defendants in these federal discrimination cases where sexual harassment has been alleged.
