Legal Question in Sexual Harassment in Virginia

If you are fired afer a sexual harassment claim

My husband has been employed in management for 17 years with the same company. For 5 months now, his female boss has touched him with her breasts, insists on long lunches alone with him, always near him etc. He filed a sexual harassment claim when it became unbearable, 1 week ago. Today, he was called to HR to discuss his unacceptable management style. At the conclusion of this counseling session and after being placed on 90 days probation, he asked about the results of his investigation, at that time he was simply told, no wrong doing was found. Does this sound right to you since he has no signed documentation in his file that he was ever even counselled? Also, even though we have retained a lawyer, should we still file with the EEOC??

Yes, it's high time that your husband file his sexual harassment claim with the EEOC, which, surely, the lawyer which he has retained must have already advised.
